I think the seller should lower the grading of the card to somewhere between an optimistic Very Good to a conservative Good, based on the seller's grading scale.
Just my opinion.
Are you amused by the "Also card may or may not have been played." part of the NM grade definition?

I was kinda interested in the adds at the top. I didn't realize the Shivan Dragon had been elevated to Legendary.
